Scheme of Auto-Renewal of Consent

Subject:     "Scheme of Auto-Renewal of Consent" based on self-certification for Red, Orange & Green category industries.

                   Chhattisgarh Environment Conservation Board intends to initiate "Scheme of Auto-Renewal of Consent" based on self-certification under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for Red, Orange & Green category industries. The issue of Auto-Renewal of Consent shall be based on the submission of self-certification of compliance of consent conditions. Presently, all consent applications for establishment, first operate, expansion/modification and renewals are considered by the Board at the level of Regional Offices for industries having capital investment up-to Rs. Five Crore in plant and machinery. The cases of industries having capital investment more than Rs. Five Crore in plants and machinery are dealt at the level of Head Office. With the increased number of industries, as per requirement under 'Ease of Doing Business' to facilitate the project proponents and also considering time limit of two months for disposal of aforesaid cases, the "Scheme of Auto-Renewal of Consent" is being introduced.
                   The strategies for effective implementations of environmental regulations include enforcement and compliance aspects, which are being handled simultaneously with the consent. In order to expedite the consent, it is now proposed to emphasis enforcement and compliance as discrete activities, along with the responsibility of declaring the compliance of regulations by the concerned industry, while seeking renewal of consent.
It has been observed that, due to rise in the number of environmental related laws, increase in public awareness towards pollution prevention and requirement of submission of consent renewal to other statutory authorities, the workload has increased considerably at the Regional Offices and at Head Office. The workload on CECB for consent management can be substantially reduced by introducing the "Scheme of Auto-Renewal of Consent" for Red, Orange & Green category industries, so that CECB can give more emphasis on compliance and monitoring.
Therefore, it is decided to accept applications henceforth for Auto-Renewal of Consent of the Red, Orange & Green category industries along with self-certification and commitment letter, and grant Auto-Renewal within stipulated time period.
The salient features of this scheme are as under:-
1.   This scheme will be applicable for all the industries under Red, Orange & Green category.
2.   The "Scheme of Auto-Renewal of Consent" shall be applicable when there is no increase in overall production capacity and also, in pollution load.
3.   For the Auto-Renewal of Consent, industries having capital investment up-to Rs. Five Crore in plant and machinery shall submit consent application form and format of  self-certification (Annexure-A) on compliance of earlier Consent / Renewal conditions duly signed by authorized person along with the prescribed fees at concerned Regional Offices. Industry shall also submit commitment towards compliance of the Consent / Renewal conditions & the environmental laws in prescribed format. (Annexure-B).
4.   For the Auto-Renewal of Consent, industries having capital investment more than Rs. Five Crore in plant and machinery shall submit consent application form and format of  self-certification (Annexure-A) on compliance of earlier Consent / Renewal  conditions duly signed by authorized person along with the prescribed fees at Head Office. Industry shall also submit commitment towards compliance of the Consent / Renewal conditions & the environmental laws in prescribed format (Annexure-B)
5.   The auto-renewal can be availed for the period of maximum Five Years for Red category of industries, Ten Years for Orange category of industries and Fifteen Years for Green category of industries subject to payment of prescribed fees.
6.   The industry shall submit application under "Scheme of Auto-Renewal of Consent" to Head Office or concerned Regional Office as per requirement. The renewal shall be issued by concerned office and be reflected in the website of CECB within 15 days.  
 6. Following condition shall be incorporated in the Consent while granting renewal under "Scheme of Auto-Renewal of Consent":-  
a) "This renewal of consent is being issued under the "Scheme of Auto-Renewal of Consent" of the Board issued vide office order no. .......... dated ................ as per self certificate submitted by authorized signatory Mr./Mrs./Ms. .......................... of M/s .......................................................
b) Chhattisgarh Environment Conservation Board reserves the rights to revoke the Consent at any time for any violation/non-compliance.
c)  In case, if the capital investment is increased by such amount that the total investment exceeds the range for which renewal fees has been paid, the industry shall have to pay the difference amount of renewal fees for the corresponding block years.
d)   In case, the prescribed fee payable is amended in future, the industry shall be liable to pay the difference amount for corresponding block years."  
This "Scheme of Auto-Renewal of Consent" shall be applicable from the date of issue of this Office Order.

Format of Request Letter Along With Self-Certification of Compliance By The Industry For Auto-Renewal of Consent of Red/ Orange/ Green Categories

Sir,
We are submitting our consent renewal application along with the prescribe fees for the same. We wish to apply for the Auto-Renewal of our existing consent referred above. We undertake the following:-

  1. We have obtained a valid 'Consent to Operate' and/or 'Renewal of Consent' from the CECB vide above referred letter(s). The present details of the manufacturing process and all other information as mentioned in the prescribed consent application form are same as per the earlier consent application submitted.

 

  1. The capital investment of the industry at the time of grant of 'Consent to Operate' by CECB vide above letter under reference-1 was Rs. ......... Crore (in words Rs. ...............................) and that at the time of grant of 'Renewal of Consent' by CECB vide above letter under reference-2 was Rs. ......... Crore (in words Rs. ...............................). The capital investment of the industry as on today is Rs. ........ Crore (in words Rs. ...............................).   1. There is no increase in production or pollution load than as referred in the 'Consent to Operate' and/or 'Renewal of Consent' issued by CECB vide above referred letters.  

 

  1. The production or manufacturing process/operation was as per the consented limits during the validity period of the earlier 'Consent to Operate' and/or 'Renewal of Consent' for which renewal has been applied.
  1. We are complying with the earlier conditions of 'Consent to Operate' and/or 'Renewal of Consent' granted vide above reference(s). 

 

  1. We undertake to comply with any new and/or altered condition(s) which may be stipulated by CECB in future and also, undertake to pay all the charges/fees in future as required by CECB.
  1. I am duly authorised by the industry to submit this self-certification along with application for Auto-Renewal of Consent. In case of any misleading information/concealment of material facts or wrong information revealed by the Board, the consent shall be liable to be revoked and under signed and the industry shall be liable for further necessary legal action. A copy of commitment letter about the authenticity of the information provided is true and correct to the best of my knowledge and belief and as per record of the industry is submitted separately for which the undersigned is fully responsible being authorised signatory.

 

  1. The above self certificate is true and correct to the best of my knowledge and belief and I have personally verified the above contents by perusal of all the documents available with the industry. A commitment in the support of self certification on the basis of personal verification of compliance of the conditions stipulated in 'Consent to Operate' and/or 'Renewal of Consent' is enclosed for which, I shall be personally liable for authenticity thereof.

It is requested to issue the Auto-Renewal of the Consent.
